There is a city attorney update meeting in the Mayor's office.
I believe that this meeting played an important role in the events that were about to unfold. I requested information about it. Below is my question and their response.
In an information request we received from the City regarding Mayor Paine’s schedule, we see that the Mayor had a “City Attorney Update” scheduled at 11am on Thursday, May 26, 2022.
In text messages between the Mayor & Melissa Hyatt on May 26, 2022, @ 8:01am, Mayor Paine confirms this meeting and Palace Bar is on his agenda.
Please furnish us with a list of attendees and the minutes of the meeting pertaining to the Palace Bar.
No such record exists as the Mayor’s updates with department heads do not constitute “meetings” as that term is defined in Wisconsin’s open meeting laws.

So, twenty minute before local tv news hits the air, about 14 hours after the non-shooting-shooting and less than 10 hours after five different police reports were finished, Officer Jago (who was not on scene of the non-shooting-shooting), sends out this press release (see below). FYI, All the police reports confirm it did not happen behind the Palace. (see blog 1 point 42)
This shooting comes a week after Police Chief Nicholas Alexander made a formal request to the city council asking the Palace Bar’s liquor license not be renewed because of a shooting inside the bar earlier this year and an increase in violence and illegal activity over the past year. https://www.fox21online.com/.../police-chief-wants...

(Superior, WI) – Shots Fired Behind the Palace Bar
An adult male is in custody following an overnight incident in which he discharged a firearm several times behind The Palace Bar in the 1100 block alley of Tower Ave.
At 1:17A.M. this morning, May 26th, 2022, officers from the Superior Police Department were dispatched to the alley behind 1108 Tower Ave.; The Palace Bar, for a male who was firing a gun into the air.
Officers arrived in the area and located a male matching the description of the suspect in the parking lot of 1102 Tower Ave; Cobblestone Hotel. The male was identified as 49 year old Blaine, MN resident Todd Gerald Peterson. Peterson was taken into custody.
Over the course of their investigation, officers were told Peterson had been kicked out of The Palace Bar by bar staff shortly before the incident. Peterson had caused numerous disturbances in the bar, and had struck the bouncer in the face prior to leaving.
A short time later, patrons called 911 to report Peterson was behind the bar in the alley, threatening to shoot the bouncer. The patrons then heard shots coming from the alley. Shell casings and a handgun were recovered from the scene.
Peterson was lodged at the Douglas County Jail, and charges of Recklessly Endangering Safety, Disorderly Conduct, and Going Armed While Intoxicated have been requested and forwarded to the Douglas County District Attorney’s Office.

Needless to say, I was very upset when I read the release where he keeps saying that it happened at the Palace. It wasn't until a few weeks ago that it occurred to me that I don’t really think officer Jago wrote the release.

As I read the Superior Police reports, 22SP07533 plus 22SP07533-2 & 22SP07533-3, from May 26, 2022 there seems to be several discrepancies between them and the “Incident Contact for Immediate Release” report issued by Office Jago on May 26, 2022 @ 16:40.
I am aware of the importance of a police report within law enforcement. It must be accurate and detail oriented.
I have a few questions that come to mind in regards to the above mention release.
1) What is the accountability chain you follow?
2) Who in the police department is responsible for gathering all reports and then writing a press release?
3) Did Officer Jago write the press release? If not, who did?

Hi Brian – please scroll below and see my responses in blue print to your three questions. Nick
1) What is the accountability chain you follow? It depends on staffing but when a Public Information Officer (PIO) is working we task them with drafting the press release. AT times written reports are not always completed so information can also verbally be obtained from officers and detectives. The release is drafted with the information known at the time. Once the draft is created it is forwarded to the Command Staff. The member of the command staff most closely involved in the case does the primary review and offers comment/correction. Any edits are re-forwarded and then a member of the command staff gives the ok to release.
2) Who in the police department is responsible for gathering all reports and then writing a press release? As noted above the PIO is the primary/first choice for this task. I not available usually a member f the command staff will draft the release. Occasionally a Sergeant is authorized to do so when needed.
3) Did Officer Jago write the press release? If not, who did? Officer Jago drafted this release.

Officer Jago mentions, not once, but four times that it happened behind the Palace Bar. How could this happen?
There were 5 police reports available to him and 6 officers that were there that night he could have spoken to. You said in your response to me yesterday. AT times written reports are not always completed so information can also verbally be obtained from officers and detectives. The release is drafted with the information known at the time.
You also said yesterday Once the draft is created it is forwarded to the Command Staff. The member of the command staff most closely involved in the case does the primary review and offers comment/correction.
So, my question is, who on the command staff that day ok'd the release?
Since officer Jago's information about the location was wrong (four times), I have to think one of two things happened.
One, he made it up. Two, he used a different source for his information other than the officers who were there the night of the shooting. I have read press releases from SPD before, that are short and without much information and say that the matter is under investigation and more info will come out later. That is perfectly reasonable. Why didn't he do that if he was not 100% sure.
My other questions to you are.
Did officer Jago just make it up?
If he didn't, then how did he reach that conclusion?
Did he have any help or input from anybody else when he wrote this release?
If the answer is yes, what is their name or names?

Good afternoon Brian – sorry for the delay but I was out of the office for about two weeks. I assume your concern is why the Palace Bar is listed when the actual casings were located in the alley behind 1106 Tower. The press release does indicate a more general address of the alley in the 1100 block of Tower Avenue. Although 1106 is where the casings were located the call originated/was dispatched at the Palace Bar and was directly related to a disturbance at the Palace and a subsequent threat of a person to return and shoot a bouncer. I believe the facts create a reasonable nexus to the Palace Bar and the press release is generally accurate.
230. I asked my wife to give me her take on the Chief’s response (comment #1). I then give my take on it (comment #2).

In rebuttal to the Chief’s answer on the press release of May 26, 2022.
In the police reports it indicates that Todd Peterson was handcuffed in the Cobblestone parking lot and his 9mm pistol, baton & magazine were found under a black truck again at the Cobblestone. On the Palace Bar’s video there is no evidence of Peterson being on our property when he shot his pistol.
There were two calls to 911 dispatch, one from the Palace and one from a witness staying at Cobblestone.
The disturbance started at Palace Bar. The bartender, bouncer and patrons did everything that any responsible person would do. The problem was not Palace Bar or Cobblestone Hotel, the problem was Todd Peterson that evening. He was staying at Cobblestone. He was obviously angry he got shown the door and wanted to retaliate.
So lumping all events of that night were just conducive to tagging Palace Bar, 1108 Tower Avenue.
Yes, the press release mentions the 1100 block of Tower but that was once! The phrasing emphasizes Palace Bar.
Removal of an angry, liquored up stranger, 911 call, no evidence on our property. Gee, guess we are guilty! Guess this press release topped with a slice of the Chief’s request to a non renewal of our license isn’t pushing any narrative! The words were chosen carefully, isn’t that convenient!

When the press release was sent out at 4:40 pm May 26, 2022, it was one of the worst days of my professional career. It’s not because of the crime that the Boozed Up Brain Dead Bozo from Blaine, Mn, Todd Peterson committed, it’s because that was the moment that my worst fears were confirmed. The cabal that includes Jim Paine, Chief Alexander, Frog Prell and Melissa Hyatt were, in my mind, colluding to find a reason to shut me down. They were looking for that “Gotcha” moment despite the facts. And they were successful.
The local tv stations were on it like nothing I’ve seen here before. I think the lead story on all of them was the Palace bar, all based on Officer Jago’s distorted press release. The two local newspapers had it online and subsequently in their print editions and continual coverage on their update emails they send out during the day and their Facebook pages. You would have thought WORLD WAR 3 broke out.
So when I read the Chief’s response to my questions about the press release (see point 229) on this blog all I could think of was “What a Big, nasty, stinky bowl of wet, soft crap this is”.
He didn’t once mention the Cobblestone where it actually happened, he just put down addresses, but he did mention the Palace three times. Even after all this time he seems to have a hard time dealing with the truth.
And then he finishes this rotten bowl of word salad with “I believe the facts create a reasonable nexus to the Palace Bar and the press release is generally accurate”.
Really?. When was the last time his department put out a press release that states a crime that happened at company A, was actually committed at company B?
He also did not address the following questions I asked.

I don’t know if the Chief ever played hockey, but he’s a hell of a skater.
And by the way, when was the last time you used the word “nexus” in a sentence,. I don’t think the Chief wrote his response without some help, just like I don’t think Officer Jago wrote his press release without some either. I could be wrong but one thing I noticed on the Chief's response to me, he also sent it to Frog Prell, the city attorney. On his previous eight emails to me, they were only sent to me.
The reason I am harping so much on this press release will be explained as we return back to the timeline of May 26, 2022 coming in the next blog. What does it take to keep a lie going? More lies!
