246. More on that later in the Blog. I want to pick up where I left off on Blog 20. I want to talk about the dreaded bar checks that the Chief said he didn't know when they started, didn’t know who started it and has no stats to prove their effectiveness. So I sent him the following email on Sept 20,2023. (See below)

Hi Chief,

 

In the text below between Officer Jago and Melissa Hyatt, Jago tells her that " I have a meeting with the Mayor on Thursday and officers have been assigned to walk into the bar and check in back minimum of twice a night for the next three months."

 

Could you tell me who is responsible for this decision and/or take me through the process of the decision. And what I mean by that is giving me the names of the people who were involved in the decision. I am not really interested in why the decision was made. I think Melissa has already spelled that out for all of us,

Hi Brian – I contacted Officer Jago and he recalls this direction be provided to him by Captain Paul Winterscheidt who is the Patrol Division Commander. I do not specifically recall what advice or involvement I may have had as there were frequent complaints made by Melissa but I am sure that I likely at some point suggested to Paul, and/or the Mayor that increased police presence and some dedicated/directed patrol were options to consider. Captain Winterscheidt is the Patrol Division Commander so I would allow him to formulate response plans to complaints, concerns, hot spots without much further coordination from my office other than me providing some ideas.

247. So the Chief doesn't recall if he was involved but he might have been, the Mayor might also might have been involved, but he’s not sure. You get the picture. But now there is a new name in the mix, Captain Paul Winterscheidt. So, I sent the Chief an email. (see below)

WEAPONIZING THE SYSTEM

248. What I am about to show you below is mind boggling. I also want you to know, that all the statistics come from the Superior Police Dept. 


On October 18, 2020 there was a shooting infraction at Centerfolds. Mayor Paine sent them a letter on Nov, 25, 2020. (See Blog, 7 Point 118)


On Dec 12, 2020 there was a shooting infraction at Lady Vi’s. Mayor Paine sent them a letter on Dec 28, 2020. (See Blog, 7 Point 118)


On Feb 1, 2020 Officer Jago sent Melissa Hyatt a text. (See this Blog, Point 246) No shooting, no weapons, No letter from the Mayor.

My Observation

250. Who is running this city? If you guessed Melissa Hyatt, you are probably right. Who the hell is in charge here? Is this how the “spirit” of this “bar checks” procedure was intended to be used? I don’t think so. This is nothing short of weaponizing a procedure to hurt another business by an out of control administration headed by Mayor Jim Paine. This is nothing short of insane. 


251. What are the consequences of these actions? When a bar check happens, you lose up to 50% of your customers. They leave. Most of them hate bar checks and quite frankly, I don’t really blame them. As I have said before, I have never seen this before I moved to Superior and I think it’s time to end them. They really don’t serve any purpose and I believe it hurts the relationship between the police and the public. And then what happens when a rogue administration uses it as a weapon against a business as they did with me. I believe these 95 bar checks in three months (Feb-Apr, 2021) probably cost us between 25 to 50 thousand dollars in business and loss of reputation. I’m sure after this onslaught of harassment, some customers stopped coming in altogether.

252. The Chief’s explanation doesn't cut it (See point 246 in this Blog). I will be sending an email to city council today (See below), asking them to suspend bar checks until a full investigation is done and then, hopefully scrap this practice altogether. Can you imagine if you are in another city and you see this kind of thing going on. You probably would just want to get your ass out of there. I have no problem when police are called in for legitimate issues but not this “walk in when you want” stuff.

Letter to City Council

253. To all City Council members,


I am asking you today to start an investigation into the SPD “bar checks” at the Palace bar between Feb 21-Apr 21 when 95 of them were conducted. Similar competitors had 2 and 0. A more detailed explanation of this is available on Palacebartruth.com Blog 21. I would also ask you to suspend this practice until your investigation is complete and hopefully this procedure will be completely disbanded after that. I think it is important to find out who was behind this obvious abuse of power and appropriate punishment dispensed.

254. I am currently going through a lot more statistics that will prove the Palace bar was no better or worse than any of the high volume bars in Superior. The Mayor and his disciples would like you to think differently, but their own statistics prove them all wrong. I will deal with this and much more on the next Blog.
