466. Hi everybody and welcome to the Blog. On the last Blog # 53 we analyzed the Mayor’s opening letter to city council and of course, Shelley Nelson. By the way, do you think he sent a copy to Melissa Hyatt? Just curious because it sounds like she could have written it. Today we will deal with the main letter(see below). The thought of that makes me sick. I would rather be waterboarded or have my wisdom teeth pulled without anesthesia. But I have a job to do so I’ll do it soaking wet and with a bloody mouth and sore gums. This letter is so full of lies it could be a long Blog. So let’s start.

MAYOR

467. In his first sentence he says “I recommend that you deny this license.”

COMMENTS

Ya right. When he says “I recommend”, he means “if you don’t you will regret it”. Why am I saying this? Because when I went to the meeting from hell, yes the one when “Vegas Jim” was in Sin City on your dime, I was explicitly told that the council will vote the way he tells them to. And then in one of the meetings that Jordan went to, pretty much the same thing was told to her. There is no secret that if you go against him you probably won’t be liking life or your council job after that. Just ask some of the present and past councilors and others how that worked out for them. Ask former city clerk Ramos who was fired how that worked for her. I will be doing an entire Blog on her in the future. I can’t imagine how toxic it is working for the city with him as Mayor.

LIE # 1

He goes on to say “The owner declined to renew the license”. That is not entirely true, in fact, I would qualify this as a lie. Let’s go back to the very first Blog.



And by the way this is after the NON-SHOOTING-SHOOTING. Yes the one that never happened on our property.

POINT 49. On May 27, 2022, I received an email from Parrish. (MY LAWYER)

I spoke with Frog yesterday. The city wants the license and aren’t interested in a compromise agreement. We need to decide whether to fight them on the 8th, or surrender and revamp the operations with an eye toward applying for a new license under Jordan’s name. I’m in Florida right now, but I’ll be checking my email periodically.

50. Within a 24-hour timeline since the shooting it seemed like the city became the judge, the jury, and the executioner. This confirmed to me what I had suspected upon receipt of the initial letter from the mayor. I felt as though he had an agenda and I realized we were never going to come to an agreement. It appears they had purposely let the clock run out and there was no reason to meet them on June 7th without a deal in hand. One of my employees was made aware from a high ranking official that the outcome of the meeting was a forgone conclusion. We were not going to get our license.


51. On May 30, 2022, I spoke to Parrish, and we mutually agreed that the meeting on June 7th would be a waste of time. Instead, we decided that I should not try and renew the license and proceed to sell the business instead.


52. On June 1, 2022, Parrish sent a letter to the city to inform them of our decision not to renew our license.

COMMENTS

I wrote all of those points back In June of 2022 and they still hold up today. The difference between June 2022 and today is that I now have the evidence to prove it. What happened here is criminal in my opinion. But it’s funny sometimes when you lie isn’t it? You have to remember what you lied about and keep up the story to keep the lie going. But some people aren’t smart enough and they slip up. Check out Jim Paine’s text to the Melissa Hyatt on June 23, 2022 at 7:40 PM. (See below) I posted this text on Blog 30 on Dec 15, 2023. COMMENTS AND LIE #2 

This what they call a “Gotcha Moment”. But this is a “Twofer” as well. This is not a slip up. This is not a mistake. This is the Mayor getting caught up in his own lie which he and Frog Prell, the city attorney have been pushing since I “decided not to renew my license”. The reason they kept emphasizing that narrative was for legal reasons. The Mayor is saying what I had thought from the beginning, “Before we pulled the license”. Oops! Sorry Frog but it looks like your client let the cat out of the bag. Oh, and don’t forget your involvement Frog when you said on May 26, 2022 “The city wants the license and aren’t interested in a compromise agreement”. There was no point for me to go to that meeting for the renewal of the license. First off at a council meeting you have three minutes of time to speak and you can’t say anything “derogatory”. Well what is “derogatory”? If I said that I think the Mayor and Hyatt had colluded in an illegal plot to shut me down, would that be considered “derogatory”?

What I am saying is that a council meeting was not the right venue to discuss the situation. And then there were these rumors or maybe you can call it harassment when some police officers kept telling us that the decision to not renew our license was a foregone conclusion. And if that’s not bad enough I also heard the Mayor was “not happy” that I called off the meeting because he had some “heavy hitters” or words to that effect, that he was going to call on to testify against us at the meeting. It’s like he wanted to use me as his trophy fish and I wasn't having it. Seems like he wanted it to be more like a show trial so he could prove what a smart guy he was. One problem. He’s not smart and I’m not stupid. I also did not have the evidence or facts to back up my allegations which ironically in the end turned out to be true.

EQUAL APPLICATION OF THE LAW? I DON”T THINK SO

The perfect example of what I am saying comes from how the city dealt with Lady Vi’s. We have talked about this before but since the time we ran that story, I feel that revisiting it is important now that we have received more information since then. There was also another letter to Centerfolds but we will concentrate primarily on Lady Vi’s. And you can see, both letters are “form” letters. The only changes is in the area where the Mayor (supposedly) spells out the infractions that they are facing. The final line on both letters also reads “We remain ready and able to assist in restoring order to your establishment and I look forward to discussing any idea that might aid that endeavor. Sincerely, Jim Paine”.

 MY LETTER

471. Wow! Where is my “form” letter. Why is my letter different? I think we all know. It's because we are next door to the notorious Melissa Hyatt. The incidents at Lady Vi’s were far more serious than anything that happened at the Palace. Any invitation to discuss a resolution like he gave to them and Centerfolds? Nope. The final line on my letter is “Please know that I continue to confer with city staff and am inclined to non-renew all city-controlled licensure relevant to the Palace Bar”. And I think when he says “Please know that I continue to confer with city staff”, I think the two people he is referring to are Frog Prell, the city attorney for legal advice and Melissa Hyatt to make sure he adheres to her every wish.

COMMENTS

472. Rules for thee...but not for me! Seems that way. The point here is that the Mayor was right when he offered to sit down with Lady Vi’s and Centerfolds and talk it out. Actually it’s usually the lawyer for the business and the city attorney that do most of the negotiating. And that is what happened with Lady Vi’s. And their lawyer was Parrish Jones who just happened to be my lawyer at the time. That’s why when I got this letter from the Mayor he told me not to worry and he would work with the city and something will be worked out. “It’s just The Mayor being The Mayor”. And I’m thinking at the time “Why, is the Mayor an A-Hole?” I never met him and didn’t know much about him. I guess I was right. The only way to come to a solution is the way that Lady Vi’s and Centerfolds were handled. We never had that opportunity. Why? Four words. Jim Paine, Melissa Hyatt. 


Long before the night of the Only shooting our fate had been decided. Those two were just waiting for the right moment to hatch their plan and when that criminal shot that gun our fate was sealed. And somehow we went from victims of a crime and with the help of a complicit, lazy and ideological press became the bad guys. False accusations and facts, weaponizing the police with their 95 “bar checks” all contributed to the negative view of us and the Palace. And the press ran with it. They never looked into their allegations and took what the Chief and Mayor were saying like it was the word of God. And we had no clue all this was happening. But I knew from day one something was wrong. I just had to figure out what to do. 


But it was such a small window of time. The letter from the Mayor was in April, Frog wanting the license back was May (After the non shooting-shooting) and the council meeting was June. Trying to get a deal with all of this going on and never having a discussion like the other two bars had ,never being given any framework for a solution or given a proposal we were screwed. As they say “We was framed”. And we were. We couldn't get a deal because they were hell bent on closing us down. Yet what happened at the Palace was nothing compared to what happened at Lady Vi’s. Below is the article of what happened to Lady Vi’s as reported by the Superior Telegram on June 16, 2021.

Superior strip club closes temporarily, liquor license could be revoked

The establishment's liquor license could be revoked immediately if its owners don't follow the terms in an agreement they reached with city officials. Superior’s City Council could have chosen not to renew a liquor and beer license Tuesday, June 15, for Lady Vi’s, 628 Tower Ave.


Instead, councilors approved an agreement reached with co-owner Norman O’Pack, who owns the business with ViAnn Rask. The license came under scrutiny after a failed attempt to license 628 Tower Ave., as Allure Cabaret. Superior Police Chief Nicholas Alexander recommended denying the liquor and beer license because the agent on the application is on probation with conditions that prohibit entry in a licensed establishment; and one of the partners in Allure Cabaret, Lamont Hines, had recently been arrested on charges of possession of narcotics and of being a felon in possession of a firearm.


“Both the drugs and firearms were located inside Lady Vi’s, where Hines was employed,” Alexander wrote in a memo explaining why the license should be denied.


The council never took formal action to deny the Allure Cabaret license but did accept City Clerk Terri Kalan’s June 1 recommendation to schedule a hearing for non-renewal of Lady Vi’s liquor license.“We determined there was likely enough history with this establishment to justify presenting to you folks the idea of non-renewing their license,” City Attorney Frog Prell said. Liquor licenses run from July 1 to June 30 the following year. Since 2014, there have been 191 police calls for service at Lady Vi’s, Alexander said. 


For Alexander, a key component of the issue is that people who run the establishment have recently been charged with crimes. Councilor Brent Fennessey questioned whether the drugs were intended for personal use or sale.“Based on quantity and packaging, I think it’s fair to say it was likely meant for sale,” Alexander said at Tuesday's meeting. Mayor Jim Paine said city officials don't have enough evidence to prove drugs were actually being sold over the bar.


Prell said the city was approached by O’Pack and his attorney, Parrish Jones. Officials engaged in discussions that led to the three-page agreement signed by O’Pack and Parrish Jones that was presented to councilors Tuesday night. Under the terms of the agreement, Lady Vi’s was shut down Friday, June 11. Before the business can reopen, no earlier than 9 a.m. Sept. 11, several conditions placed on the business must be met. They include not employing Hines and another individual in any capacity or allowing them on the premises at any time. O’Pack agreed to submit names and birthdates of employees for background checks and to deny employment to those who do not qualify, giving the city a voice in hiring at Lady Vi’s.



Paine said the dancers who perform adult entertainment at Lady Vi’s are not subject to background checks. The dancers are independent contractors, rather than employees, Paine said. In talking to experts in human trafficking, he learned background checks on the dancers could be detrimental to the women, who may have been traumatized in the past. Other conditions include displaying anti-human trafficking posters that reference the National Human Trafficking Hotline and seeking anti-human trafficking training at their own expense; meeting monthly with a designated member of the police department to discuss compliance issues; working with police to curb guns, drugs and disturbances; and designating staff for litter control.


Failing to adhere to the agreement could result in the immediate revocation of the liquor license without an administrative hearing. “You’re effectively revoking the license unless they meet every one of these terms,” Paine explained to the council.“I think they understand the thinness of the ice they’re on,” Prell said.


After a 15-minute recess so councilors could review the agreement, councilors split 8-2 to renew the license subject to the terms of the agreement. Councilors Brent Fennessey and Craig Sutherland voted against the conditional renewal. Fennessey initially said he liked the idea of the agreement, but after further thought said it is the equivalent of the city “babysitting” the establishment and was beyond the scope of the city’s responsibilities.

COMMENTS

A lot of weird stuff in this article. First off, Sutherland and Fennessey voted against the license. That’s a little weird because those two are usually very pro business. I really don’t know much about this story so I am assuming there was more going on then what we are reading in the Telerag. Next the Chief recommended not renewing the license. Not too weird but he once told me that they are not inclined to shutting down businesses. Frog Prell recommended not renewing the license. That’s not weird. That’s what I would expect from him.



But here is what I found very weird. The Sultan of Safety AKA Mayor Paine seemed to be defending Lady Vi’s. The guy who couldn’t close me down fast enough seems to be standing up for them. The Chief said “Based on quantity and packaging, I think it’s fair to say it was likely meant for sale.” Paine then said “city officials don't have enough evidence to prove drugs were actually being sold over the bar.“

Fair enough. What happened to the Sultan of Safety? Then this happened. On Sept 12, 2022 the Duluth News Tribune published this.

Man injured in shooting at Superior bar

Witnesses said the shooting took place in the men's restroom at Lady Vi's early Sunday morning.

SUPERIOR — A man was injured in at Lady Vi's on Tower Avenue early Sunday morning, according to a news release from the Superior Police Department. Police responded to a call of shots fired at 1:53 a.m. and arrived within 30 seconds of being dispatched. Officers encountered a large crowd in the area. Witnesses said a shooting occurred inside the men's restroom. Officers cleared the building and were unable to locate any suspects or victims, the news release said.



Duluth Police Department contacted Superior police and said a man had arrived at the Essentia Health emergency department with a non-life-threatening gunshot wound. It was later determined that the man was a victim of the shooting.

COMMENT

On June 16, 2021 as I reported on a minute ago the Mayor said “Failing to adhere to the agreement could result in the immediate revocation of the liquor license without an administrative hearing.“You’re effectively revoking the license unless they meet every one of these terms,” Paine explained to the council.



Then Frog said “I think they understand the thinness of the ice they’re on.”

Well I guess the ice wasn't all that thin. As far as I know they are still open and I can’t find comments or anything on-line from the Mayor, Frog or anybody else. So how do you get a bar closed in Superior? Move next to A Dozen Excuses. She really should change the name to A Million Complaints.
