AND PAINE GOES NUTS. REALLY NUTS!!!!

458. Welcome everybody to today’s Blog. As I said on the last Blog we are going to analyze the letter that our unhinged, unprofessional and completely out of control Mayor dropped on City Council on Dec 6, 2022, only a few hours before the meeting was to start. I like to call it “LETTER FROM A MADMAN”. If you ever shake hands with him, you might want to check if you still have all your fingers afterwards.

THE FIRST LETTER

Notice how he calls Jordan (the buyer) “The Applicant”. Real classy Jimbo. I decided yesterday,June 5,2024, to send an email to Frog Prell the City Attorney. See below.

Hi Frog,

I have a couple of questions about procedure today.

1- Is the Mayor allowed and is it legal to submit this letter as well as the letter I am sending you in a separate email to council with less than four and a half hours before the meeting?

2-Is it also legal to send a copy to Shelly Nelson of the Superior Telegram a copy of the letters?

3-Is it legal to not send a copy to Jordan (the buyer) and to me (the seller)?

Good afternoon, Mr. Noel,

I should remind you that I represent the city and cannot give legal advice to citizens. To give legal advice to a citizen about matters involving the city is not only outside of the scope of my duties, but would likely be a conflict of interest.


I can tell you, as a general principle, that the type of communication you’ve referenced (in your questions 1-2) is not illegal. Furthermore, failure to copy a person who might be subject of such a communication is generally not illegal.


There are, of course, exceptions to rules and I urge you to contact a private attorney if you have further inquiry.

COMMENTS

First off I want to thank Frog for his quick response and secondly I am not here today to bash Frog but I do want to bash the system. What he is telling me and all of you is that his job among other things is to protect the employees of the City of Superior when it comes to litigation no matter if they are on the right or wrong side of the law. Oh, and you the taxpayers, yes the ones who actually pay Frog and the rest of the city employees, go get a lawyer. After all they are so cheap and by the way good luck finding one locally since so many of them do business with the city that they won’t take your case anyway. It’s not Frog’s fault. He just explained his job description. He just told you what we, the taxpayers pay him to do. 


So what happens when you have a beef with the city and all your calls go unanswered or you just get the runaround until you are pretty much worn out? Quit? Many of you do. Fight? How? Can you afford a lawyer? Do you have or want to put in the time to go through the process? Well after talking to people and getting emails from some of you about your stories, unfortunately most of you do give up. And I really can’t blame you. I have lived this nightmare since April of 2022. That’s a little over two years now and I can tell you it has been the worst two years of my life. But I am committed to get to the bottom of this story and to get justice not just for me and my family but for my staff, customers and any other people affected by what has happened. I also want justice for the residents of Superior. You deserve a better government than what you have now.

SO HOW DO YOU SOLVE THIS PROBLEM?

ETHICS COMMITTEE

I did some research and I found out that most cities have “Ethics Committees”. Guess who doesn't? Yep, Superior. And why is that? I’m not sure but I do have my suspicions. When you go on the Superior City website you will see they have over 45 committees but no “Ethics Committee”. Imagine that, over 45 committees in a city this size. And you wonder why there are lots of people who advocate for smaller government. I bet you could get rid of half of these and they would never be missed.

The way to achieve that is starting with your elected officials. Call the Mayor and your city councilors and ask them why we don’t have one and would they support having one. And if they don’t ask them why. Right now the residents of Superior are almost helpless when it comes to trying to resolve issues they have with the city. You need to do something. I have lived in four cities in my life, Ottawa, Ft. Myers, Superior and Las Vegas. The current government in Superior headed by Jim Paine and the ten current councilors is the worst one by far I have ever experienced. If the city ever needed an “Ethics Committee”, the time is now. If the Mayor and councilors do not support having one or don’t take it up for discussionI think that is telling you, the taxpayers all you need to know.

A CITY ATTORNEY FOR THE PEOPLE

After reading Frog’s email describing his role which is to represent only city employees (some of them corrupt in my opinion) I thought why not have a city attorney who would only work for the taxpayers. In fact he or she would not be allowed to do any work for city employees. Why should politicians have an attorney at their beck and call free of charge paid by the taxpayers and the taxpayers have no similar avenue for them. The attorney would not be representing you in court, but would guide through the process, explaining law and procedures saving you the taxpayers thousands of dollars and lots of time. At least you would feel like you have a voice because right now you don’t. Again, call the Mayor and city councilors. See if you can get the ball rolling. After all the money that “Sour Note” Paine has been pissing away recently on Frankie’s Bar/Princess Theatre, Carnegie Library and as I call it “Disconnect Superior” which could be north of 60 million dollars, I think an investment in a City Attorney for the People could be the best wage we pay to anyone at city hall.

VOTE

If Superior was a stock I would short it as long as we have this Mayor and this city council. We need to vet these people more. We have to find better quality people to run for office. I will do a Blog about this whole voting issue on a future blog soon. This city right now is going nowhere fast We have a dysfunctional government in charge and voting is one of the options to get us back on the right track.

I was curious that if somebody at the city was being sued by a taxpayer and you represented that person at the city and that person was found guilty, does that person have to reimburse the city for your time?
